RANDY SMITH ELECTED TO PENSION BOARD

Randy Smith has been elected as the Fire Department Representative to the Palm Bay Police and Fire Pension Board. Randy replaces current FD Rep, Mike Havener who was not re-elected. We thank Mike for his time on the Board while wishing Randy the best as he moves into the complicated world of Pension Board Trustee. Ben Kiszkiel, current City Council Appointee withdrew his name from consideration of re-appointment by the City while Bill Yonce was re-appointed to a two year term by the City. We thank and recognize Ben for past years of service to the fund. Replacing Ben on the Board will be James Brock, the area Marketing Coordinator for the Poppa John Corporation. Mr. Brock was appointed to the board by the City for a two year term.
UNION CONTINUES WORK ON LAYOFF ARBITRATION

Vice President Jim Bliss continues to work on an Arbitration Case that deals with the Layoff and Recall of Fire Inspector Mike Havener. The issues falls back on the pay that Brother Havener should be receiving based on contract language. Brother Havener has seen a payroll reduction of over $20,000 due to the Layoff and Recall, and the union feels that this violates our contract. Members at the March membership meeting will be asked to officially approve the expenditure to continue the case forward. Our Labor Attorney has indicated that this is an important case not just to Mike Havener, but to anyone in our unit who would be faced with Layoff and Recall. We have never had such an issue in our history, and it must be heard to establish a base line for future layoffs should they occur.
MEMBERSHIP APPROVES FUNDING FOR ARBITRATION

The membership approved the expenditures necessary to send the Layoff and Recall Issue relating to Fire Inspector Mike Havener to Arbitration. Due to layoff and recall, Inspector Havener has lost almost $20,000 per year in salary. This goes against the contract and will be heard by an impartial arbitrator from the Federal Mediation and Conciliation Service (FMCS). A panel of specially trained arbitrators has been presented to the City and Union and each will strike alternately until one is left. The one that is left is the arbitrator. We would expect that once chosen, a hearing date will be scheduled and we would estimate that the hearing will be sometime in May. Vice President Jim Bliss is working with our Labor Attorney firm in the preparation of the case. The case involves the decrease in salary for Inspector Havener, and back pay to the date of the layoff. This is the first layoff issue our Local has had in our over thirty year history.
